The information below was released late this morning, Wednesday, Nov. 18, in a press release from the 16th Circuit Solicitor's Office stating Brad Morris, former Union County Clerk of Court, was arrested yesterday:
Sixteenth Circuit Solicitor Kevin Brackett announced Wednesday morning that former Union County Clerk of Court Brad Morris was arrested yesterday, November 17th, 2009 by Agent Scott Williams of the South Carolina Law Enforcement Division and charged with the offenses of Embezzlement of Public Funds and Misconduct in Office.
These charges stem from an investigation into the misappropriation of public funds held in trust by Mr. Morris during his tenure as the Clerk of Court for Union County. According to Solicitor Brackett, Mr. Morris was booked into the Union County Detention Center by Agent Williams and taken in front of magistrate judge for bond setting pursuant to state law.
Brackett stated that each of these charges carries a potential sentence of 10 years in prison meaning that Mr. Morris is exposed to a maximum of 20 years in state prison. Under our law these charges are merely allegations at this time and until Mr. Morris is proven guilty of the charges beyond a reasonable doubt in a court of law then he is presumed innocent of them.
Brackett stated that the next step in the proceeding will be to determine if Mr. Morris wishes to have a preliminary hearing and after that the charges will be presented to the Grand Jury of Union County for their consideration. Mr. Morris is represented by Mr. Rick Veith of Spartanburg County.
The investigation is ongoing into these allegations and the final result of the audit is not expected for some time said Brackett. The number of accounts, transactions and length of time involved in collecting all of the records necessary has proven longer than anticipated. Brackett acknowledged the excellent work done by SLED Agents Bob Cathey and Scott Williams in this case and noted that these cases were some of the most complex to investigate due to the volume of records involved and the accounting knowledge necessary to review and assess them.
