Traffic accident results in fight, arrest

Union Public Safety officers had their hands full with a wreck and a fight that ensued afterwards Thursday.

Timothy Edward Atchley, 32, of 1458 Pineland Road, was charged with assault and battery of a high and aggravated nature in the case.

The man Atchley is accused of hitting, Thomas Eric Whitener, 42, of 107 Crestview Drive, is in the intensive care unit at Wallace Thomson Hospital.

Around 5 p.m. officers were called to a wreck involving three cars at the intersection of North Duncan By-Pass and Harwood Heights. Traffic was snarled.

Officer Randy Canupp spoke to a witness who said she had been following Whitener for a while, he was all over the road, and she had called 911 to report this. The witness said Whitener never put on brakes and ran the red light and struck another vehicle. Whitener then got out of his car, went in McDonald’s and got in line as if to order.

Several other witnesses gave Canupp the same information.

As Canupp was talking to the witnesses, people in McDonald’s began screaming that there was a fight inside. He and Sgt. David Brewington went in and found Whitener had been struck in the face and was unconscious on the floor. The report said he had been assaulted by Atchley, the husband of one of the drivers involved in the wreck.

EMS arrived to treat Whitener. The report said Canupp could smell alcohol coming from Whitener as he was loaded onto a stretcher.

The report said Whitener was still unconscious when Canupp went to the hospital to question him.

Blood samples were collected from Whitener. A check of his driver’s license showed he was driving under suspension at the time of the wreck.

Drug arrests

Ricky Dale Keisler, 35, of 214 Gin Circle, Buffalo, was charged Tuesday with distribution of marijuana, distribution of marijuana within one-half of a park, possession with intent to distribute marijuana and possession with intent to distribute marijuana within one-half mile of a park.

Jonathan Edward McAbee, 31, of 502 Drug Store St., Buffalo, was charged with possession of marijuana.

A report said narcotics officers with the sheriff’s office provided an operative with money and sent the operative to McAbee’s home, where the operative bought marijuana from Keisler.

Based on the buy, officers got a search warrant for the residence. Keisler was the only one there. Marijuana was seized from his pockets along with $240 cash, including money from the previous buy.

Marijuana also was seized from a black safe and from a dresser drawer in a bedroom where it appeared that children slept.

Two sets of scales also were seized.

McAbee was arrested because he is the owner of the home and the marijuana was located in the children’s bedroom.

The report also said the residence was very unsanitary and photos were taken by officers. Copies of the photos and the arrest report will be given to the Department of Social Services.
