Ethanol plant permit OK appealed

COLUMBIA - Three property owners are appealing DHEC's decision to issue a permit for the proposed ethanol plant to be built near Carlisle, asking that certain additional requirements be included in the permit.

Steve McCaslin, permanent section manager of DHEC's Bureau of Air Quality Control, said the agency issued a permit for construction to Congaree Bio Energy on Nov. 6. The decision to issue the permit came after a months-long permitting process that included a public meeting and public hearing in Carlisle in which DHEC personnel and officials of Osage Bio Energy, the company building the plant, answered questions and received comments from the public.

McCaslin said that with the issuance of the permit, a 15-day period allowing for appeals of the decision began. He said that on Nov. 19, the agency received an appeal of its decision. The appeal will go to DHEC's board which has 60 days to conduct a review of the information contained in the appeal. At the end of that period, the appellants have 30 days to appeal to the administrative law court. After that, McCaslin said, they could potentially appeal it further up the judicial system.

The appeal was filed by Charles Jeter, Dr. Elaine Jeter and Susan White, all of whom own property near the site of the proposed plant. Jeter said the purpose of the appeal is to have the following conditions included in the permit:
