UNION — A Whitmire man who pleaded guilty in March to a 2011 collision that left two men dead will learn his punishment this afternoon.

The Sixteenth Circuit Solicitor’s Office announced Tuesday that sentencing for Matthew Olin Fain will be held this afternoon at 2 p.m. in General Sessions Court. Fain pleaded in March to two counts of felony DUI in March but his attorney requested that his sentencing be delayed until May and Judge Lee S. Alford of York granted the request.

Fain, 26, 620 Evans St., Whitmire, was charged felony DUI by the S.C. Highway Patrol in a May 19, 2011 collision that took the lives of Toy Edwin Grady, 67, 4198 Cross Keys Highway, Union, and James Anderson Jeter, 60, 5427 Cross Keys Highway, Enoree.

The accident occurred around 6:50 a.m. on S.C. 49 approximately 6.5 miles west of Union. Grady was pronounced dead at the scene while Jeter, who was his passenger, was transported to Spartanburg Regional Medical Center. He died at Spartanburg Regional Hospice Home on June 20, 2011.

The accident left Fain hospitalized with a broken bone in his right foot, a crushed left elbow, a broken upper femur in his left leg, and severe internal damage. Due to his injuries, Fain was not arrested at the time of the accident, but upon his release from Spartanburg Regional Medical Center he was placed under house arrest by Union County Magistrate Jimmy Crocker who also set his bond at $25,000.
