UNION — A Spartanburg attorney with nearly 40 years experience practicing law will serve as interim city attorney for the City of Union.


Union City Council voted unanimously Tuesday to appoint Lawrence E. Flynn Jr. as the city’s interim attorney. Flynn, who has been a practicing attorney since 1974, is associated with the Pope Ziegler Law Firm in Columbia but practices law in Spartanburg. Following his appointment, Flynn said most of his practice involves representing municipalities in the Upstate region and that this should mesh well with the needs of the City of Union.


Mayor Harold Thompson said that the city has been without a municipal attorney since August. He said that Flynn has done previous work for the city and that with his experience and background he could provide the city with the legal services and counsel it requires.


While Flynn is serving on an interim basis, Thompson said he has appointed a committee composed of councilmen Robert Garner, Yates Giles, and Jim Wilson to conduct a search for a permanent municipal attorney. Thompson could not say how long the search would last, but that he wanted the committed to do a thorough job and select the most qualified attorney for the position.


Thompson raised the possibility, however, that the next city attorney will not be a full-time employee of the city but will instead work on a retainer. By doing so, Thompson said the city will still receive the legal services it needs but at reduced cost.


Union has been without a municipal attorney since Aug. 20 when council accepted the resignation of William E. “Billy” Whitney Jr. Less than a week after his resignation Whitney was arrested and charged by the Union County Sheriff’s Office with Malfeasance and/or Misfeasance or Misconduct in Office. The warrant for Whitney’s arrest stated that there was probable cause to believe that on or around July 8, 2011, and on Sept. 7, 2012, he dismissed charges against criminal defendants in exchange for sexual favors.
